Role Responsibilities

The Condominium Dispute Resolution Tribunal's (the Tribunal) mandate is to provide timely, fair, and independent dispute resolution services, consistent with relevant legislation, regulations, bylaws, rules, guidelines, and the principles of natural justice. The quasi-judicial Tribunal administers dispute resolution services for condominium corporations and owners in relation to specific matters of jurisdiction as set out in regulation, and in accordance with the Condominium Property Act (CPA), Condominium Property Regulation (CPR), and the new Condominium Tribunal Regulation as well as condominium corporation bylaws and rules.

Reporting to the Director of the Tribunal, the Legal Officer of the Tribunal is responsible for providing legal advice and guidance to inform Tribunal operations and decisions. The role will develop and lead training for members and staff to enhance the quality and integrity of all Tribunal services and operations.

Key responsibilities include but are not limited to:

  • Assess risk by identifying, evaluating, and explaining legal risks arising from organizational decisions, operations, or proposed actions. Provide clear actionable advice to mitigate or avoid risk. Advise on risk impacts related to administrative fairness, procedural integrity, and compliance with government legislation.
  • Develop and deliver comprehensive training materials for staff and members.
  • Assist Tribunal staff with complex case management issues and potential process solutions.
  • Inform the Chair and Director of emerging legal issues and recommend options and process enhancements to help shape decision making.
  • Provide expert legal advice to staff and Tribunal members to facilitate impartial and timely resolution of all applications.
  • Advise and consult on corporate matters such as annual reporting and business planning to ensure alignment with Government of Alberta policies.
  • Provide legal guidance for the development of Tribunal policies and rules that guide resolution of disputes in compliance with legislation and principles of administrative law.
  • Provide legal opinions on case law and develop a database of relevant precedential decisions.
  • Represent the Tribunal at the Court of Kings Bench for appeals/judicial review matters.
  • Participate as a member of the Tribunal management team to provide leadership to staff.
  • Work with Tribunal Members, parties and ministry representatives to ensure relationships are developed and maintained. This may include representing the Tribunal at public events and ministry committees.

Drawing on your experience with agencies, boards, or commissions you will be able to guide Tribunal processes and decisions with confidence and precision.

Your advanced analytical skills, attention to detail, and strong communication abilities will help you synthesize complex issues, prepare legal briefs, and deliver advice that meets the needs of the Tribunal, ministry, and stakeholders. You will lead and manage initiatives across cases, balancing multiple priorities while fostering collaboration and trust with colleagues and external partners.

Qualifications

Bachelor of Laws (LLB) or Juris Doctor (JD) degree and a minimum of four (4) years experience as a qualified legal practitioner. 

Required:

  • A qualified legal practitioner with a minimum of four years’ experience across multiple practice areas, including Civil and Administrative law.
  • Membership in good standing with the Law Society of Alberta.

Assets: 

  • Preference will be given to those that have a minimum of 6+ years of directly related experience in administrative law.
  • Experience with agencies, boards, or commissions (municipal, provincial, federal).
  • Knowledge and experience of the stakeholder community, and the current and emerging issues that could come before the Tribunal is an asset.
  • Knowledge of the related legislation, regulations, and both regulatory and non-regulatory frameworks, and policies that relate to the Tribunal’s mandate.
